TERMS AND CONDITIONS OF USE

The campaign has been postponed and will end on Monday 10th of October 2016. Therefore we will be receiving participations for filemata until Thursday 6th of October, regarding the flights of Monday 10th of October 2016, when the campaign terminates.
Any participant in the Campaign or any third party may obtain an exact copy of this deed at own expense. 

1) Scope of the Campaign

The société anonyme with the corporate name AEGEAN AIRLINES S.A., with registered offices at 31 Viltanioti St., Kifissia, Attica, (hereinafter the "Organizer"), is staging the promotional Campaign "Filepse Tous (Treat Them)", (hereinafter the "Campaign"), in cooperation with the company with the corporate name OGILVY ONE WORLDWIDE – ATHENS – PROMOTION, ADVERTISING AND DIRECT MARKETING S.A., engaged in advertising (hereinafter "OGILVY ONE") with registered offices at 10 Imathias St., GR-15344 and Tax Registration No. 094188587, Tax Office: Athens FAEE Tax Office (jointly referred to as the "Organizers"), to be launched on Monday 5 September 2016 at 17:00 (Eastern European Time) and ending Tuesday 27 September 2016 at 23:59 (EET). The Campaign web tools of the Campaign and its general monitoring will be overseen by OGILVY ONE.
Specifically, the Organizer invites the public to visit the site www.filepsetous.com to choose and send a gift from a series of products, along with a wish, to a random foreign passenger travelling with the Organizer airline departing on a direct flight operated by the Organizer from the following airports: Athens International Airport, Thessaloniki International Airport, Heraklion International Airport, Rhodes International Airport and Kalamata International Airport, to a country on the Organizer's foreign network. The flight will be operated with Airbus A320 and A321 aircraft during the period of the Campaign, meaning from Monday 5 September 2016 at 17.00 to Tuesday 27 September at 23:59. The package of gifts selected by participants will be delivered by the Organizer's flight crew to the passenger occupying the seat selected by the participant on the flight operated by the Organizer. If there is no foreign passenger assigned to the seat chosen by the participant, the gift package will be given to the foreign passenger sitting nearest to that seat.
The order of steps to be followed by users are as follows:

The first step is to visit www.filepsetous.com and choose one of twelve (12) different gift packages to send.
The second step is to select the departure airport among the Athens International Airport, Thessaloniki International Airport, Heraklion International Airport, Rhodes International Airport and Kalamata International Airport.
The third step is for the user to select one of the available flights appearing in random order. If desired, the refresh button will bring up a different flight. Similarly, the user selects the seat of the passenger to whom the gift is to be delivered. 
In the fourth step, the user will have to fill out a card to accompany the gift. To proceed to this step, users must

The name and Facebook profile photo of the user will be printed on the card to accompany the gift. Participants will also include their place of residence on the special participation form. Users can preview the card to approve it before confirming the gift delivery.  Participants expressly and unreservedly state that: a) the photos and personal data they use are their own; b) they have relevant authorizations in the event other persons are pictured and grant the Organizers the rights to use these for advertising or other purposes associated with the Campaign. In the event that the seat selected by the user for sending the gift is not occupied by a foreign passenger, the package will be given to the foreign passenger sitting nearest the selected seat.

The Organizers assume no obligation to secure or facilitate access to Internet sites or to provide the relevant facilities to any interested party with respect to their participation in the Campaign. Access to the Campaign is only permitted under the operating terms and conditions for the applicable server and the technical and other conditions and specifications for the Campaign. The Organizer hereby assumes that each participant has exclusive control over the personal data he/she provided and is exclusively responsible for their truth. The Organizer shall not be liable for any amount charged to the participants/users due to the aforementioned grounds.

Up to four (4) gift packages may be delivered on the same daily flight. Users may place as many orders as they wish through the website; however, only one (1) gift package per day may be selected for delivery to a foreign passenger travelling with the Organizer airline. 

2) Delivery process

Up to two hundred and sixty four (264) gift deliveries will be made daily, starting on Friday 9 September 2016. Visitors to the site will be able to choose from among flights scheduled for the next four (4) days from the day they visit the site to complete the process described in Article 1. Therefore, the last entries will be accepted on Friday 23 September 2016 for flights scheduled for Tuesday 27 September 2016, when the Campaign is to end with the final deliveries. 
In the event there are more than 264 orders for gift deliveries per day, there will be an electronic drawing among all entries for that particular day to decide which gifts will be sent. The Organizers are not bound to publicize the results of these drawings. Each drawing will result in 264 users and as many winners to ensure that 264 gifts are delivered each day.
Participants whose gifts have been selected for delivery on flights scheduled for the following day will be informed by e-mail with regard to said delivery.

3) Personal data:

The Organizers may publish on the Campaign website personal data (such as names and photographs) of users who have sent a gift package and photographs, along with data on passengers who received the gift and who followed the specific instructions that accompanied the gift. The Organizers may also exclude users who do not comply with the terms of the Campaign.
Specifically, the organizers are entitled to exclude users from the Campaign and to not reproduce visual material, particularly when said material contains insufficient or inaccurate user information, or if it offends or degrades the organizers' image or prevailing morals; or infringes personal data or privacy rights of any third party; infringes intellectual property rights of any third party, or if users have not secured the required authorisation; if it contains illegal or immoral material; depicts minors; infringes registered trademarks; or in cases where users do not act in accordance with public and business ethics bound by the laws of the Greek State, or the contents of which are contrary to the law or morals, are defamatory or contrary to Constitutional notions of protection of life, honour, property, human value, or which constitutes the subjective or objective substantiation of any crime, or is characterized by a racist disposition; or which contains pornographic material; or material which offends the democratic political system, freedom of religion, protection of minorities, promotes racism and xenophobia, or which infringes the individual and social rights of Greek citizens.
Provided the participants accept these terms and conditions of use, the Organizers will collect and publish at their absolute discretion the materials and messages of participants on the Campaign website (www.filepsetous.com), the Aegean Airlines website (el.aegeanair.com) and on Aegean Airlines social media (Facebook, YouTube, Instagram, Twitter) for the purpose of advertising or further promoting messages for commercial or other purposes, as well as to promote the Campaign.

4) Eligibility

Anyone over the age of 18 who is a Greek citizen may participate in the Campaign. Individuals falling into the following categories are excluded from the Campaign:
(a) anyone under the age of 18,
(b) anyone who has expressly not agreed to these terms and conditions of use;
In such cases, the aforementioned companies shall not be liable to any individual due to inappropriate use of this service. The Organizer reserves the right (but is not required) to exclude from the Campaign, at any stage thereof, persons who, in its view, may have used (or attempted to use) unlawful means regarding their participation or who breach any of the terms of this article.
Unlawful means shall mean, inter alia, cooperation with other persons, use of devices, arrays, computers and/or software to facilitate automated or multiple participations without human intervention, etc.
In all events, the Organizer may exclude any user/visitor/participant from the Campaign using any lawful means.
It is hereby specified that participation in the Campaign does not require purchase of any product and there is no charge to the participants.
Participation in this Campaign is conditional upon access of the participants to the Internet using their own technical means. It shall be voluntary and requires prior agreement of the participants with the terms and conditions of the Campaign.
Users are entitled to submit multiple entries, but may only be chosen once in a daily drawing for their gift to be delivered to a lucky passenger.

5) Gifts

Up to 5,700 gift packages may be delivered during the promotional Campaign and will include the products as listed in detail in website LINK while supplies last.

If one of the gift packages runs out, it will no longer be available on the Campaign's website. If all gift packages run out before the end of the Campaign, the Organizer is not obligated to make more gift packages available.

6) Date of start/end of Campaign

The Campaign starts on Monday 05 September 2016 at 17:00 (EET) and ends on Tuesday 27 September 2016 at 23:59 (EET). The Campaign computers (including any automated subsystems – count-down web tools made available to the Organizer by OGILVY ONE) shall be the official timer of the Campaign determining the Start Time, the End Time as well as the time of active sending of an entry or apparent receipt by the application of a Campaign entry.
It is expressly stated that after the end date of the aforesaid Campaign, as announced in the terms and conditions of use on the Organizer’s webpage during the Campaign closing procedure, no entry will be accepted by, or be binding upon, the Organizer in relation to whether the entry was submitted in good time or not.

7) Change of terms and conditions of use

The Organizer reserves the right to amend these terms and conditions at its discretion, informing visitors/users about any amendments and changes through the Campaign website (www.filepsetous.gr).

8) Express Declaration – Consent – Acceptance by the Participants 

All participants in the Campaign hereby fully and unreservedly accept these terms and conditions of use. Persons who do not accept the terms and conditions of use should not participate in the Campaign. Participation in the Campaign implies the express and unreserved consent of the participant for collecting, entering, maintaining and processing personal data in files kept by OGILVY ONE for the purpose of carrying out this Campaign, in accordance with the provisions of Law 2472/1997 (as in force from time to time). The purpose of collecting, maintaining and processing personal data by OGILVY ONE is to support the necessary actions that are part of this specific promotional Campaign only. Persons whose particulars will be included in this file are entitled to access it, raise objections or request that the data referring to them be deleted, in accordance with articles 12 and 13 of Law 2472/1997. Once this promotional Campaign ends, the file will be destroyed. OGILVY ONE is entitled to forward personal data related to participants to companies affiliated with it in Greece and abroad for purposes of operational and IT services that are part of its business relationship with participants in the Campaign or for statistical purposes. OGILVY ONE is also entitled (provided it has received express consent from participants/interested parties) to use for its own purposes or to disclose personal data of participants to third parties to advertise its services of the Organizers or companies with which the Organizers are affiliated, or for market research or other similar activities and to remotely promote its own services or those of third parties. Any participant may at any time have access to and update his/her personal data or object to further processing of such data in accordance with Article 13 of Law 2472/97, by prior notice addressed to OGILVY ONE (10 Imathias St., GR-15344, Gerakas, tel. 210 6660000).

Furthermore, all participants explicitly and unreservedly acknowledge, state and accept that:
(a) The personal data provided in the context of this Campaign may not belong to any third party, whether a natural person or legal entity, but only to themselves;
(b) They are over the age of 18; 
(c) Their privacy is neither violated nor degraded in any manner whatsoever due to their participation in the Organizer's Campaign, in which they are taking part using their personal data;
(d) they do not infringe personal data or privacy rights of any third party;
(e) They do not infringe intellectual property rights of any third party;
(f) They expressly consent and allow the Organizer to use their personal data (full name, telephone, e-mail address) for the purposes of the Campaign;
(g) They grant their consent and authorization to the Organizers to promote the Campaign and its results through the traditional and electronic press and through the Internet for its entire duration. The Organizers reserve the right to use and publish any news relating to the conduct of the Campaign;
(h) they grant their consent and authorisation for exploiting any relevant event through advertising, without requiring any further notice or any compensation. The Organizers also reserve the right to publish audiovisual material related to the delivery of gifts.

9) Withdrawal of Notice – Amendment of Terms - Liability

The Organizer is entitled to withdraw the Campaign notice, in whole or in part, or to amend these terms (including the duration of the Campaign and the dates for delivering gifts), or to substitute gifts offered during or after the Campaign or after its conclusion. In such an event, the Organizer bears no obligation to compensate users who send gifts through the Campaign website nor foreign passengers who receive the gifts selected through the Campaign. The Organizer shall bear no liability under any circumstances for any direct or indirect losses, expenses or costs which may arise from any interruption, malfunction, delay or any other reason with regard to the Campaign prizes. Furthermore, the Organizer bears no liability, whether criminal or civil, to any gift recipient or other third party, for any accident and/or loss and/or bodily injury or material damage that may occur to the recipients, directly or indirectly related to the prize or arising from any other cause. It is expressly understood that, after the conclusion of this Campaign or after the new date that may be set following any postponement, extension or change in the duration of the Campaign, entries shall no longer be accepted and any entries submitted shall automatically be considered null and void and shall not be binding on the Organizer and/or any other third party. In that case, by participating in this promotion, participants irrevocably accept that they do not acquire any right or claim against the Organizer nor do they become entitled to demand continuation of the Competition that has ended or delivery of the prizes not awarded or any further compensation.

10) Trademarks – Intellectual Property

Participants shall neither have nor acquire any rights whatsoever in respect of the trademarks, names, marks, logos and other insignia of the Organizer or OGILVY ONE.

11) Consent for use of visual material

By taking part in the Campaign, participants grant their consent and authorise the Organizers to display their photographs and personal data related to said Campaign and/or its results on radio or television, or in printed and electronic media and/or on the Internet (including social media). Thus, the Organizers reserve the right to use and publicize for advertising purposes the list of persons who sent and received the gifts in this promotional Campaign, any video or film, and potentially to use any information related to this Campaign for advertising purposes; participation in this promotional Campaign automatically implies consent to that end and grants necessary intellectual property rights at no cost.

12) Applicable Law – Jurisdiction

These terms and conditions and all types of contractual and non-contractual relations arising as a result of their implementation shall be governed by Greek law for all participants. Any dispute related to the Campaign that may arise in the future falls under the exclusive jurisdiction of the Courts of Athens, even with respect to non-residents of Greece. By taking part in the Campaign, participants declare that they have been fully informed of all the details in the terms and conditions of the Campaign and unreservedly accept them in their entirety.
